TERMS AND CONDITIONS
Lessee shall be deemed to have accepted these terms and conditions and guarantees payment for all charges upon accepting a quote and/or scheduling service. Rental Equipment shall be used only for its intended purpose and is expected to be returned to the Lessor in as good of condition as when it was delivered to Lessee, normal wear and tear is accepted.

DAMAGE/LIABILITY All rental equipment is utilized at the Lessee’s sole risk, and the Lessee is accountable for any resulting loss, damage, or claim arising out of the operation or use of the rental equipment. Lessee is fully responsible for any loss, theft, damage, or destruction of the equipment or supplies, and must promptly notify Lessor of any such incidents within 24 hours. The Lessee indemnifies and holds the Lessor harmless from any claims, losses, or damages related to bodily injury or property damage arising from equipment use, regardless of fault. In the case of damaged or lost units, Lessee bears responsibility for on-site damage or loss, excluding normal wear and tear, and must promptly inform the Lessor. Lessee is obligated to cover repair expenses and reimburse the Lessor for replacement unit costs.

DELIVERY/PICKUP TIMES, SERVICE SCHEDULE The Lessor will make every effort to deliver on the scheduled delivery day. However, due to inclement weather, traffic conditions or mechanical breakdowns, delivery times or dates could vary. The Lessor will promptly contact you if there are delays in delivery. If you need the unit at a specific time, we suggest you request delivery for the previous day. The Lessor does not offer specific pickup times, only scheduled days. The trucks are scheduled to pick up for every customer on the route on the scheduled day and if we miss one, it will be corrected as soon as possible. In the event the Lessee is unable to service the rental equipment on the service day, due to a holiday, inclement weather, or other interfering circumstance, the Lessee shall service the equipment on the earliest business day.

EQUIPMENT PLACEMENT The Lessee does not need to be on-site for delivery. To ensure we provide you with world-class service, placement instructions are required for deliveries. The Lessee will provide a map and/or picture of the desired placement or mark the desired location with a sign. If, after delivery, the Lessee requests the equipment be moved, it will be at an additional fee.

ACCESSIBILITY The Lessee is responsible for providing accessibility for the Service Technician to deliver and service all rental equipment on site. Lessee will forfeit any scheduled service and/or delivery without credit or refund in the event the Service Technician cannot access equipment due to but not limited to, relocation of rental equipment, debris, vehicle, or structure blocking accessibility. If the Lessee has requested to relocate the rental equipment, the Lessee must communicate with Lessor and ensure the Service Technician has full access to the rental equipment at time of pickup and delivery to avoid additional charges.

If a gate code is required to access the desired placement location, the Lessee should provide the gate code at the time of order. If the delivery cannot be made, the Lessor will promptly notify the Lessee and afford the Lessee a reasonable opportunity to provide the gate code and reschedule the service at an additional fee.

The Lessee acknowledges that there are limitations to where equipment can be placed. All portable toilets must be placed within 35 feet from where the truck can park. If the toilet needs to go through a gate, a minimum of 48" width is required. The service technician cannot drag the unit over a fence, down or up steps, or place the unit on an uneven surface.

Lessee acknowledges that Lessor may drive on Lessee’s property and accepts full responsibility for all damage that may occur. This includes damage to areas that the truck may contact (e.g., driveways, walkways, lawns, landscaping, tree limbs, ariel wires and cables). Additional charges may apply for waiting time. Lessor will not be responsible for closed roads, inclement weather, etc. that prevents access to the renter property.

HANDLING The Lessee agrees that only staff of the Lessor is to move the rental equipment. Any request to move the rental equipment must be scheduled in advance by calling the office of the Lessor. Additional fees will be charged on a case-by-case basis.

“The three P’s...Only Poop, Pee and Paper” belong in portable toilets and restroom trailers. The Lessee is responsible for preventing any contamination of rented equipment and for providing adequate trash receptacles at or near all portable restrooms. Any trash found in the equipment will be placed in the trash receptables, if they are within a reasonable proximity of the equipment. If not, trash will be bagged and left on the premises. Any hazardous waste, including radioactive, volatile, flammable, explosive, or toxic, found in a toilet at the time of service will require additional charges at the discretion of the Lessor.

INSURANCE REQUIREMENT Restroom Trailer Customers: A Certificate of Insurance naming The Throne Depot LLC, as additional insured and loss payee with full replacement cost is required. Lessor will not release delivery of any restroom trailer prior to receiving COI.

SPECIAL EVENT CUSTOMERS A 50% deposit of total contract is due at time of signing to confirm and reserve the rental equipment. Lessee will forfeit 100% of deposit amount if cancelling within one month of scheduled date written in contract. Balance is due two weeks prior to delivery. Delivery will not occur if 100% of contract is not received. The Lessee will provide a picture or map of the requested placement 1 week prior to the scheduled delivery.

CANCELLATION POLICY To receive a full refund, cancellation requests must be made at least 1 business day in advance. Requests to reschedule must also be made at least 1 business day in advance. Same-day cancellations will not be refunded as the truck is loaded and routed the day-prior.

TERMINATION OF SERVICE The Lessee may terminate service at any time. The Lessor shall not be responsible for loss of any personal property left in equipment. The Lessee is responsible for the full amount on any invoice for the duration of the bill cycle.

PAYMENT Construction and/or Reoccurring Rental/Service Customers: Credit card and autopay is required for non-account holders and/or for those beyond 45 days past due. Notice to owner will be processed within the first 30 days of delivery. Nonpayment will result in a “Stop Service” status and could result in a lien placement of said property. After 90 days of nonpayment, the rental equipment will be removed. The billing cycle will be in advance every 28 days and interest on any past due balances over 30 days shall be at the rate of 3.5%. Late fees will NOT be removed from the account by partial payment of the billed amount. If payment is not made, and this account is referred for collection, Lessee will pay collection costs. If it becomes necessary to file suit or obtain the services of any attorney, Lessee will pay attorney fees and/or costs of suit.

PRORATING Agreed upon rates are for the complete billing period and are not to be prorated.

PAYMENT ADJUSTMENTS Lessor may increase pricing to account for any increase in disposal, fuel, or transportation costs; any increased costs due to uncontrollable circumstances including, without limitation, changes in local, state, or federal laws or regulations, imposition of taxes, fees, or surcharges and acts of God, such as floods, fire, etc. The Lessor may also increase pricing to reflect increases in the Consumer Price Index for the municipal or regular area where the service address is located. Increases in charges for reasons other than as provided above require the consent of the Lessee which may be evidenced verbally, in writing or by the actions and practices of the parties.

WINTERIZATION During the months of December – March, a winterization fee will be applied to cover the cost of materials required to prevent the portable tank from freezing.

ERRORS & OMISSIONS Lessee reserves the right to correct any erroneous information that may appear in the invoice or may have appeared in a prior invoice including, without limitation, Customer’s name or address, or billing amounts.
